In August 2023, AFCA temporarily paused complaints lodged by bankrupt or former bankrupt consumers pending the outcome of a Court proceeding. This is because implications of the judgement may change how we approach these complaints.  

The Court has now handed down its judgement which has wide-reaching implications for AFCA and other organisations dealing with bankrupt or former bankrupt consumers. AFCA and its legal team are working through what this means for these complaints. While we finalise our approach, these complaints will remain paused.  

We appreciate the impact this may have and assure you we are doing all we can to finalise our approach.  

We will contact impacted members as soon as we have an update or within 60 days of the pause remains.  

We will provide the same update to complainant parties.
